امام شافعیؒ کے زمانے میں ایک خلیفہ نے اپنی بیوی کو عجیب طریقے سے طلاق دے دی، اور یہ طلاق بعد ازاں فقہ کا بہت بڑا مسئلہ بن گئی۔
بادشاہ اپنی ملکہ کے ساتھ بیٹھا تھا کہ ہنسی مذاق میں اُس نے ملکہ سے پوچھ لیا کہ، ” تمہیں میری شکل کیسی لگتی ہے ؟ ”
ملکہ جو بادشاہ کی عزیز ترین بیگم تھیں، وہ مذاق کے موڈ میں بولی، ” مجھے آپ شکل سے جہنمی لگتے ہیں “۔
یہ فقرہ سننے کے بعد بادشاہ کو غصہ آ گیا اور بولا، ” میں اگر جہنمی ہوں تو تمہیں تین طلاقیں دیتا ہوں۔۔۔! ”
ملکہ نے یہ سنا تو اُس نے رونا پیٹنا شروع کر دیا۔
بادشاہ کو بھی کچھ دیر بعد اپنی غلطی کا احساس ہو گیا۔
اگلے دِن بادشاہ سلامت نے ملک کے تمام علماء، مفتی صاحبان اور اماموں کو دربار میں بلا لیا۔
اور اُن سے پوچھا کہ،
” کیا اِس طریقے سے میری طلاق ہو چکی ہے؟ ”
سب کا باری باری یہی کہنا تھا کہ، “ہاں، آپکی طلاق ہو چکی ہے، اور شریعت کی روشنی میں ملکہ عالیہ اب آپ کی زوجہ نہیں رہیں۔۔۔! “،
لیکن اِس محفل میں ایک نوجوان مفتی بھی موجود تھے، وہ ایک طرف ہو کر بالکل خاموش بیٹھے رہے۔
بادشاہ نے اُن سے بھی یہی سوال پوچھا تو انہوں نے عرص کیا، ” جناب، یہ طلاق نہیں ہوئی، کیونکہ آپ نے مشروط طور پر کہا تھا، کہ اگر میں جہنمی ہوں تو میں تمہیں تین طلاقیں دیتا ہوں،
اور ابھی تک یہ طے نہیں ہوا کہ آپ جہنمی ہیں کہ نہیں ہیں،
آپ کو اگر کوئی شخص جنتی ہونے کی گارنٹی دے دے تو آپکی یہ طلاق نہیں ہوگی۔”
بادشاہ سلامت نے جوشیلے انداز میں پوچھا،
” لیکن مجھے اِس چیز کی گارنٹی کون دے گا۔۔۔؟ ”
سب علماء کرام نے اِس سوال کے جواب پر اپنے سر جھکا لیے، کہ دنیا میں کون شخص جنتی ہے اور کون جہنمی ہے اِس کی کوئی گارنٹی نہیں دے سکتا۔
اُس نوجوان مفتی نے جب تمام علماء کرام کو خاموش دیکھا تو وہ بادشاہ سلامت سے مخاطب ہوا،
” بادشاہ سلامت !
میں آپکو یہ گارنٹی دے سکتا ہوں،
لیکن اِس کیلئے میں آپ سے ایک سوال پوچھوں گا، اگر آپکا جواب “ہاں” ہوا تو میں آپکو جنتی ہونے کا سرٹیفکیٹ دے دونگا۔۔! “۔
بادشاہ نے کہا، “ہاں، پوچھو۔۔۔!”
نوجوان مفتی نے پوچھا،
” کیا آپکی زندگی میں کبھی کوئی ایسا موقع آیا تھا، کہ آپ گناہ پر قادر تھے، لیکن آپ نے صرف اللہ تعالیٰ کے خوف سے وہ گناہ چھوڑ دیا تھا۔۔۔؟ ”
بادشاہ نے سر اُٹھایا اور کہا،
” ہاں، ایک بار ایسا ہوا تھا،
میں اپنی خوابگاہ میں داخل ہوا تھا اور وہاں ایک نوکرانی صفائی کر رہی تھی،
وہ لڑکی انتہائی خوبصورت تھی، میں بھٹک گیا،
میں نے دروازہ اندر سے بند کر لیا۔
میں غلط نیت سے اُس لڑکی کی طرف بڑھا تو اُس نے رونا شروع کر دیا، اور وہ چلّا کر بولی،
” اے بادشاہ ! اللہ سے ڈرو، وہ تم سے زیادہ طاقتور ہے”۔
میں نے جب یہ سنا تو میرے اُوپر اللہ تعالیٰ کا خوف طاری ہو گیا۔
میں اگرچہ بادشاہ تھا،
وہ لڑکی میرے کمرے میں تھی،
میں نے دروزے کو اندر سے کنڈی لگائی ہوئی تھی،
اور اُس وقت دنیا کی کوئی طاقت مجھے بُرائی سے نہیں روک سکتی تھی۔
لیکن میں نے صرف اللہ تعالیٰ کے خوف سے دروازہ کھول دیا، اور اُس لڑکی کو جانے کی اجازت دے دی۔۔۔!”
یہ سب سن کر وہ نوجوان مفتی مسکرایا اور اُس نے قرآن پاک کی سورہ النٰزعٰت کی آیت نمبر 40 اور 41 کی تلاوت فرمائی،
*” وَأَمَّا مَنْ خَافَ مَقَامَ رَبِّهِ وَنَهَى النَّفْسَ عَنِ الْهَوَىٰ o فَإِنَّ الْجَنَّةَ هِيَ الْمَأْوَىٰ “*
*ترجمہ ???? جو اپنے رب کے سامنے کھڑے ہونے سے ڈر گیا اور اُس نے اپنے نفس کو خواہشات میں پڑنے سے بچا لیا تو ایسے شخص کا ٹھکانہ جنت ہوگی”
اِس کے بعد نوجوان نے بادشاہ سلامت سے کہا،
” میں آپکو گارنٹی دیتا ہوں کہ آپ جنتی بھی ہیں، اور آپکی طلاق بھی نہیں ہوئی۔
عزیز دوستو !مسلمان ہونے کے ناطے ہم ہر وقت جنت کے متلاشی ہوتے ہیں،
لیکن آپ اِس واقعے سے اندازہ لگائیے کہ جنت تو ہر وقت ہمارے سامنے موجود ہوتی ہے،
اِس کے لیے صرف ایک چیز کی ضرورت ہوتی ہے اور وہ یہ کہ، ہم خوفِ خدا کی وجہ سے ہر اُس گناہ سے توبہ کریں جس کو کرنے کی ہمارے اندر طاقت اور قدرت موجود ہوتی ہے۔
*اللہ تعالیٰ ہمیں اپنے خوف میں مبتلا رکھے اور ہر قسم کے گناہ سے بچائے

During the time of Imam Shafi’i, a caliph divorced his wife in a strange way, and this divorce later became a huge issue in jurisprudence.
The king was sitting with his queen and jokingly asked the queen, “How do you like my appearance?”
The queen, who was the dearest begum of the king, jokingly said, “You look hellish to me.”
After hearing this phrase, the king got angry and said, “If I am from Hell, I will give you three divorces!”
When the queen heard this, she started crying.
The king also realized his mistake after some time.
The next day, King Salamat called all the scholars, muftis and imams of the country to the court.
And asked them,
“Am I divorced this way?”
All of them took turns to say, “Yes, you have been divorced, and in the light of Sharia, Queen Alia is no longer your wife!”
But a young Mufti was also present in this gathering, he was sitting on one side completely silent.
When the king asked him the same question, he said, “Sir, this divorce did not happen, because you said conditionally, that if I am from hell, I give you three divorces.”
And it has not yet been decided whether you are hell-bent or not.
If someone gives you a guarantee of being a paradise, you will not get this divorce.”
King Salamat asked enthusiastically,
“But who will guarantee me this thing?”
All the scholars bowed their heads on the answer to this question, that no one can give any guarantee as to who in this world is a person from heaven and who is from hell.
When that young mufti saw all the scholars silent, he addressed Badshah Salamat,
” Long live the King !
I can guarantee you,
But for this I will ask you a question, if your answer is “yes” then I will give you a certificate of being a paradise! “.
The king said, “Yes, ask!”
The young Mufti asked,
“Has there ever been such an opportunity in your life, that you were capable of committing a sin, but you left that sin only out of fear of Allah Ta’ala?”
The king raised his head and said,
“Yes, it happened once,
I entered my bedroom and there was a maid cleaning,
That girl was so beautiful, I got lost.
I locked the door from inside.
I went towards that girl with the wrong intention, she started crying, and she cried out,
“O King! Fear Allah, He is more powerful than you”.
When I heard this, the fear of Allah came over me.
Though I were a king,
That girl was in my room.
I bolted the door from the inside,
And at that time no power in the world could stop me from doing evil.
But I only opened the door out of fear of Allah, and allowed that girl to go!”
Hearing all this, the young Mufti smiled and recited verses 40 and 41 of Surah Al-Nazat of the Holy Quran.
*”And as for those who fear the position of their Lord and forbid their souls from God, then Paradise is the abode”*
*Translation He who feared to stand before his Lord and saved his soul from falling into desires, such a person’s abode will be Paradise.
After that the young man said to Badshah Salamat,
“I guarantee you that you are also heavenly, and you are not divorced either.
Dear friends, As Muslims, we are always looking for paradise.
But you can infer from this incident that heaven is always present in front of us.
It requires only one thing, and that is, that we repent of every sin that we have the strength and power to commit, out of the fear of God.
May Allah keep us in His fear and save us from all kinds of sins
